Terms of service

These Terms of Service ("Terms") apply to foodbabyco.com and to everything you buy from us. In these Terms, "Foodbaby", "we", "us" and "our" mean Pacer Agency Pte Ltd, trading as Foodbaby, a company registered in Singapore. "You" means you, whether you're browsing, buying, or reading something we've published.

By using this site or placing an order, you're agreeing to these Terms. If you don't agree with them, please don't use the site.

These Terms should be read alongside our Privacy Policy, Shipping Policy and Refund Policy, which form part of them.

1. Who can buy from us

You need to be at least 18 to place an order. If you're under 18, you're welcome to read the site, but someone with parental responsibility for you needs to make any purchase.

You confirm that the information you give us when ordering is accurate and complete, and that you're authorised to use the payment method you're paying with.

2. Health and nutrition disclaimer

This is the most important section in this document, so it's near the top rather than buried at the bottom.

Everything we publish is general information, not personal advice. Eat Your Way To Fertility, this website, our blog, our free guides, our emails and our social media are all written for a general audience. They are not a substitute for individual medical, nutritional or fertility care, and they cannot take account of your particular history, diagnosis, medication or circumstances.

We don't diagnose or treat anything. Nothing we publish is intended to diagnose, treat, cure or prevent any medical condition, including infertility.

We don't promise an outcome. Fertility is affected by many factors, most of which are not diet. Nothing we sell or publish is a guarantee that you will conceive or carry a pregnancy, and we make no such claim.

Please keep your own care team in the loop. Talk to your doctor, specialist or dietitian before making significant changes to how you eat, before starting any supplement, and particularly if you are pregnant, breastfeeding, undergoing fertility treatment, taking medication, or managing a medical condition. If you're mid-cycle in a treatment protocol, check with your clinic first.

If something is urgent, don't email us. We can't provide emergency or urgent care. Contact your doctor or your local emergency service.

Amara Lindenmayer is an Accredited Practising Dietitian. Reading our books or our website does not create a dietitian–client relationship. One-to-one consultations are a separate service, arranged separately, and are governed by the terms we agree with you at the time.

3. Orders

Adding something to your cart is not a contract. Your order is an offer to buy, and a contract is only formed when we send you an email confirming that your order has been dispatched.

We may decline or cancel an order, in whole or in part, if the item is out of stock, if there has been a pricing or description error, if we can't ship to your address, or if we reasonably suspect fraud. If we cancel an order you've already paid for, we'll refund you in full.

We try hard to describe our products accurately, but we don't warrant that every description, photograph or other content on the site is completely free of error. Printed colours can differ slightly from what you see on screen.

4. Prices and payment

Prices are shown in the currency selected at checkout and may change without notice, though changes won't affect orders we've already accepted. Shipping costs are shown before you pay, not after.

You are responsible for any import duties, taxes or customs charges levied by your own country. These are not within our control and are not included in what you pay us. See our Shipping Policy for detail.

Payment is processed by our payment providers. We don't store your full card details.

5. Delivery

Delivery timeframes given on the site are estimates, not guarantees, and we're not responsible for delays caused by carriers, customs or events outside our reasonable control. Risk of loss or damage passes to you on delivery. Full detail is in our Shipping Policy.

6. Returns, and rights you have regardless of what this document says

Our voluntary returns policy is set out in our Refund Policy.

Separately from that policy, you may have rights under the consumer law of your own country that cannot be excluded, restricted or modified by anything in these Terms — including, in Australia, the consumer guarantees under the Australian Consumer Law, and in Singapore, your rights under the Consumer Protection (Fair Trading) Act. Nothing in these Terms excludes, restricts or modifies any of those rights. Where a good or service fails to meet a consumer guarantee, you are entitled to the remedies the law provides, and our returns policy applies in addition to those rights, not instead of them.

7. Our content, and what you may do with it

Eat Your Way To Fertility, its recipes, its photography, its illustrations and its text, together with everything on this website — writing, images, design, logos and downloadable guides — are owned by Foodbaby or used under licence, and are protected by copyright and other intellectual property laws.

You may read, use and cook from what you've bought, for your own personal, non-commercial use.

Without our written permission, you may not:

• copy, scan, photograph or reproduce substantial parts of the book or the site;
• republish, resell, licence, or distribute our content, including on social media, in a blog, in a newsletter, or in a course of your own;
• use our content, recipes, images or brand for commercial purposes;
• remove or alter any copyright notice or attribution;
• use automated tools to scrape, crawl or harvest the site or its content; or
• use any of our content for text or data mining, or to train, fine-tune or ground any machine learning or artificial intelligence system.

We expressly reserve our rights in relation to text and data mining and AI training. Quoting a short passage with clear attribution and a link back is fine, and we'd be pleased if you did.

8. Digital products

Where we sell a digital product, such as a downloadable guide or an online programme, we grant you a personal, non-transferable, non-exclusive licence to access it for your own use. You may not share your access, your login or the files with anyone else.

Because digital products are delivered immediately and can't be returned, we generally don't refund them once you've accessed them — except where a refund is required by law, or where the product is faulty or not as described.

9. Wholesale and stockists

Books bought at wholesale, for resale, are sold on separate terms agreed with us in writing. These Terms apply to retail purchases through this website.

10. Reviews and anything you send us

If you send us a review, photograph, comment or message, you keep ownership of it, but you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our business, including in marketing. You confirm that it's your own work and that it doesn't infringe anyone else's rights.

We may edit reviews for length or clarity, and we may decline to publish content that's unlawful, misleading, abusive, or that makes a health claim we can't stand behind.

11. Third-party links and services

The site links to other websites and relies on third-party services for payments, shipping and analytics. We don't control those sites or services and aren't responsible for their content, their products or their practices. Following a link is at your own risk.

12. Availability of the site

We aim to keep the site available, but we don't guarantee uninterrupted access. We may suspend, withdraw or change any part of the site without notice.

13. Limitation of liability

Subject always to section 6, and to the extent permitted by law:

• we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, opportunity or data, arising from your use of the site or our products; and
• our total liability to you in connection with these Terms is limited to the amount you paid us for the product the claim relates to.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

14. Changes to these Terms

We may update these Terms from time to time. The version in force is the one published on this page when you place your order, and the "last updated" date at the top tells you when it last changed.

15. Governing law

These Terms are governed by the laws of Singapore, and the courts of Singapore have non-exclusive jurisdiction over any dispute. "Non-exclusive" matters here: if the consumer law of the country you live in gives you the right to bring a claim in your own local courts, this clause doesn't take that right away.
